Terms of Service

These Terms of Service ("Terms") govern your use of the Dayfold application and related services ("Dayfold", the "Service"), operated by Shadberry Studios LLC ("we", "us", "our"). By accessing or using Dayfold, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Dayfold is a personal planner that lets you organize tasks, calendars, projects, habits, routines, a journal, pomodoro sessions, and birthdays. You can use Dayfold offline on a single device, or sign in to sync and back up your data across devices.
2. Eligibility and accounts
You must be at least 13 years old (or the minimum age required in your country) to use Dayfold.
You may use Dayfold without an account. If you create an account, you are responsible for:
- Providing accurate information.
- Keeping your sign-in credentials secure.
- All activity that occurs under your account.
Notify us at support@dayfold.app if you suspect unauthorized use of your account.
3. Your content and ownership
You retain all rights to the content you create in Dayfold - your tasks, notes, plans, attachments, and other data ("Your Content"). We do not claim ownership of Your Content.
You grant us a limited license to store, process, back up, and sync Your Content solely to provide the Service to you. We do not use Your Content for advertising and do not sell it. How we handle your data is described in our Privacy Policy.
You are responsible for Your Content and for maintaining your own copies of anything important to you.
4. Acceptable use
You agree not to:
- Use Dayfold for any unlawful purpose or to store or share unlawful content.
- Infringe the intellectual property or privacy rights of others.
- Attempt to gain unauthorized access to the Service, other users' data, or our systems.
- Interfere with, disrupt, or overload the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent this restriction is prohibited by applicable law.
- Resell, sublicense, or commercially exploit the Service without our written permission.
We may suspend or terminate access that violates these Terms.
5. Cloud sync and offline use
If you use Dayfold offline, Your Content is stored only on your device and is not backed up by us. You are responsible for that local data.
If you sign in, Your Content is synced to your private cloud space. We take reasonable measures to keep it available and secure, but we do not guarantee uninterrupted or error-free sync, and you are responsible for keeping your own backups of important data.
6. Paid subscriptions
Some features may be offered as part of a paid subscription. If you purchase a subscription:
- Payment is charged through your Apple App Store or Google Play account, and is subject to that store's terms.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store or Google Play account settings.
- Any free trial converts to a paid subscription unless canceled before the trial ends.
- Refunds are handled by Apple or Google according to their policies; we generally cannot issue refunds directly.
Prices and features may change; we will give notice of material changes as required by the app stores and applicable law.
7. Third-party services
Dayfold relies on third-party services, including Google Firebase (accounts, sync, storage) and Sign in with Apple and Google Sign-In (authentication). Your use of those features may also be subject to the third party's terms. We are not responsible for third-party services we do not control.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that data will always be preserved. You use the Service at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, Dayfold and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service - even if we have been advised of the possibility of such damages.
To the extent liability cannot be excluded, our total liability is limited to the amount you paid us for the Service in the twelve months before the claim, or, if you paid nothing, the equivalent of USD 50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Termination and account deletion
You may stop using Dayfold at any time and can delete your account and data from Settings → Data → Delete account.
We may suspend or terminate your access if you violate these Terms or if required for legal or security reasons. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.
11. Changes to the Service and these Terms
We may modify or discontinue features of the Service at any time. We may also update these Terms; when we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of Dayfold after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Shadberry Studios LLC is established, without regard to conflict-of-law principles. Any disputes will be subject to the courts of that jurisdiction, unless applicable consumer-protection law in your country of residence provides otherwise.
